View Full Version : Ebay and Paypal can kiss my ass

So I got suckered. I hate to admit it but I got duped and bought what turned out to be a counterfeit copy of Photoshop CS2 off a seller on ebay. The seller listed an address as Ft. Lauderdale FL but when the package arrived, its origin was China. Needless to say I was skeptical and on futher examination and running of the serial, it turned out to be a very masterful forgery with just a few errors. Such as "designed for Windews" printed on the box. I did not install the software and placed a claim with Paypal for a refund. Paypal got back to me a week or so later and informed me that I need to send the software back to China, unopened, to the seller and I might get "a partial refund" and no refund of my postage costs. WTF???? Isn't it illegal to send counterfeit ANYTHING through the mail and now they want me to send back illegal goods to the seller so he can resell it to some other unfortunate buyer? Its like they are encouraging me to perpetuate a crime. Like such a broad sweeping criminal enterprise that has the resources to manufacture such a close forgery would actually be stupid enough to provide a real mailing address anyway.

So this guy gets to continue to peddle illegal counterfeit shit with Ebay and Paypal's blessings and I am out some money. Now I have to ask, since I am just "the little guy", is there anything that can be done? Is there any class action suit? Should I send the fake to Adobe? What can I do, besides refuse to do business with Ebay? My confidence in that site is shaken to the point that I do not want to buy anything from any buyers on Ebay unless its something that doesn't matter if its counterfeit or legit, such as basic hardware like a bracket or screw, which sucks because I am NEVER home and rely on e-tailers and sites like Ebay alot. From what I have heard Ebay has become the bazaar of illegal Chinese knock offs, flying in the face of what would get most any other enterprise of that size shut down by the federalles. How CAN they be shut down, or should I say IF they can be?

Contact your bank, and put in a claim. They will reverse the money immediately and investigate

Contact Microsoft, and Adobe, and let them pursue copyright infringement.

Contact Ebay regarding falsified information being given with the sale posting.

Contact the Commerce Dept. and provide the information provided to us.

Contact the US Postal Inspectors regarding international shipping of counterfeit products.


Basically, provide them with the same information you put here, and allow them to take any appropriate action regarding counterfeiting of product, and selling counterfeit to US citizens via Ebay, and doing so under false pretenses of being located in the US. Maybe nothing will come of it, and maybe it will.

I cannot believe there was much of a feedback rating for the seller, which is always the first thing I look at when buying anything, even a used five dollar cd.

Yeah, you paid with a credit card probably, right? Call your credit company and have them charge it back.

Oh, and, of course, provide negative feedback on the seller in ebay. :)

I'll buy from new sellers for small items, but one or two negative comments, depending on the feedback, will keep me off a seller completely.
