Interesting. I agree that you cannot legislate to revoke the ability to participate in a group activity based on the potential for STDs or physical harm vs. the actual intent or high expectation of something awful occurring in these situations. The same potential exists in every club encounter, marriage license, hockey game, ice fishing accident, visit to a wax museum... the Canadians could explode into some physical encounter gone south at any moment! ;)
