The most interesting thing will be to see if his nominee when confirmed morphs into something ideologically unexpected

Souter was supposed to be a very right wing type of Judge, he was appointed by Bush sr...he ended up being one of the most liberal.

A good reflection on who Justice Souter is, and why he will be remembered as one of its better jurists, was posted on Balkin yesterday:
http://balkin.blogspot.com/2009/05/justice-souter-and-common-law-judging.html
and a NYT discussion of him here:
http://www.nytimes.com/2009/05/03/weekinreview/03greenhouse.html?ref=politics
A thorn in both Bushes' side for insisting, despite his conservative credentials, on putting the integrity of the law and its actual effects upon human beings above ideology, an incredibly earnest and humble man who never allowed himself to be exalted by his position, he will be missed. Obama will be very lucky to find someone of his caliber, and so beyond politics; for while David Souter has not been the most ostentatious judge, nor has he penned many landmark rulings (although he has written some brilliant dissents in recent years), he has unquestionably been the Court's most faithful servant, in the truest sense of the word, of the current era.

It has been presented as an almost guaranteed nomination of a female appointee. There are some talented candidates to be sure.
It is also a foregone conclusion that anyone he nominates who is not a bonafide looney toon will be confirmed with little hassle.
