Moussaoui Asks to Withdraw Guilty Plea

ALEXANDRIA, Va. - Convicted Sept. 11 conspirator Zacarias Moussaoui says he lied on the witness stand about being involved in the plot and wants to withdraw his guilty plea because he now believes he can get a fair trial. In a motion filed Friday but released Monday, Moussaoui said he testified March 27 he was supposed to hijack a fifth plane on Sept. 11, 2001, and fly it into the White House "even though I knew that was a complete fabrication."

Hmm.... someone correct me if I'm wrong.... but...

1. He had a fair trial....

2. He chose to plead guilty

3. There was no evidence that would support the case being thrown out as a mistrial

4. Because of the laws regarding double-jeopardy, he can't be tried for the same crime again.

5. He can appeal, but not get a new trial.

Here is the rule (11(d)) referenced in the Defendent's motion:

(d) Withdrawing a Guilty or Nolo Contendere Plea. A defendant may withdraw a plea of guilty or nolo contendere:

(1) before the court accepts the plea, for any reason or no reason; or

(2) after the court accepts the plea, but before it imposes sentence if:

(A) the court rejects a plea agreement under Rule 11(c)(5) (http://www.law.cornell.edu/rules/frcrmp/Rule11.htm#Rule11%28c%29%285%29); or

(B) the defendant can show a fair and just reason for requesting the withdrawal.

I guess if he could proove he was coerced into a guilty plea then it would benefit him in his bid to get an appeal. The problem is he's shown he wants to be martyred for it, he's all but admitted to doing it in his actions in court. What's to appeal? He asked to be put away, and now he is. He needs to suck it up and deal with the medicine he dealt to himself.

IF and it's a BIG IF he didn't do anything wrong, then why would he have acted like he did? Why would he have asked to be martyred?
