It's a terribly long read, it's crazy, and really some people are dumb. I skipped a few parts but got the jist of it. Basically someone stole a phone and was dumb enough to take pictures of themselves and friends on the phone. The owner's friend is trying to get the phone back and posted the theif's pictures on the net. The above link is the whole story.
I'd have just cancelled the damn phone were it me.
I'm sorry if this was already posted here, I didn't see it. Also, I found this on the EQ2 forums first.

LOL...this is the best part. $50 bucks says he'd leave there with a phone in his ass.
Sashacristal8905: i got ball this is my adress 108 20 37 av corona come n do it iam give u the sidekick so I can hit you wit it
So, anyways..this is my story. If you happen to know these people in the picture please let me know at: stolensidekick@gmail.com I am not going to go to the address posted above, because a.) Not going to waste my time going to a probable fake address b.) If it is real, there will be a physical altercation and I would probably wind up arrested which would do no good to anyone. I’d rather just embarrass the thief as much as possible. Teach them a lesson on the etiquette of returning peoples lost belongings.

Interesting... Hope he wins and gets his phone back.
Though while reading I stumbled terribly on the emails from the suspects to the writer. I think that was english, but i'll be damned if it made much sense.

And so it ends with the teenager's arrest and the phone retreived. YAY for justice. Now, to see if he gets sued.

I liked the mom's comment at the end of the story. Gee, maybe if the daughter didn't take the phone, or would have been up front in the first place NONE of this would have happened. I'll admit we only got one side of the story, and from that there were conflicting stories of how the teen came into possession of the phone.
I don't know if he will get sued or not. It would be interesting. Even if they bring up some half hearted civil suit he could rack up more in lawyer fees than the $350, especially in NY. Thats the crappy thing about the system. In my county you can file a small claims, up to $5k, and your cost is $75 to file + about $50 for the sherriff to serve the papers. He could represent himself, but unless he knows the laws/presents his side well he could lose. This would be a toss up. Much more cut and drywhen you have a contract of some sort and be able to say that so and so didn't live up to their end of the contract.

Well reading the back story he had allot of people (attorneys included) contact him. I'm going to go out on a limb and guess someone will represent him pro-bono. But that family suing for that is BS, they had multiple chances to return the phone. Buying a cell phone especially that one for $50 from a subway platform....yeah you know it's hot. Give me a freaking break.

Yeah but their only way to sue him with a chance, while slim, to win will be the harrassment that his site generated of the daughter. One could say that he generated that harrassment, but he didn't do it and the family played into with their IMs and having multiple stories. I doubt they have a leg to stand on, but as history has shown people will sue when they think they can win.
His best defense will be the conversations he had with the family about the phone. If he kept those, he'd probably win the suit. Unless the family hires lawyers from the Boston firm Crane, Poole, and Schmidt. They never lose. ;)
