Yeah...if your cops are beating people down for flipping the bird then your department is ripe for a few multi-million dollar lawsuits. Where was this? I could use some extra cash.

There is a difference between "simply" flipping someone the bird and walking up to them face to face and cursing and ranting and flipping them the bird. That can be argued as hostility and someone has the right to defend themselves. For all the cop knew the guy could have pulled out a gun or knife next.
